Whistleblower report

The so-called Whistleblower Protection Act (HinSchG) came into force on July 2, 2023, to implement the EU Whistleblower Directive. This law enables better protection for people who notice legal violations in the course of their professional activities and want to report them.

One of the key regulations of the law is the option of submitting these reports confidentially. To ensure this confidentiality and the protection of employees, this internal reporting office has been set up. If you observe potential misconduct at NOW, we ask that you use this whistleblower channel.

Data protection

The reports and any uploaded files are transmitted to our internal reporting office in a technically protected manner, without disclosing data to unauthorized third parties. Completely anonymous on request. NOW’s internal reporting office is legally obliged to treat information about identity confidentially. It does not matter whether you give us your name or prefer to remain anonymous. It is ensured that the report does not result in any disadvantages for you.

For your own protection, we would also like to point out that you yourself should treat the data relating to the report with absolute confidentiality. Do not talk to third parties about the report you have made. Make sure that you do not leave any data that can be viewed/read by third parties (for example, on NOW’s technical devices) that allow conclusions to be drawn about your report.

The legal basis and purpose of the data processing is our legitimate interest in uncovering and stopping legal violations (Art. 6 Para. 1 S.1 lit. f) GDPR), and our legal obligation to protect natural persons who have obtained information about violations in connection with their professional activities and report them to internal reporting offices (Art. 6 Para. 1 S.1 lit. c) GDPR in conjunction with § 1 Para. 1 HinSchG). Should your information involve special categories of personal data, the legal basis is Art.6 Para.1 S.1 lit. c), Art.9 Para.1 lit. g) in conjunction with §10 HinSchG. We only store the data for the duration of the investigation and do not pass it on, unless we are legally obliged to do so.

If you intentionally or grossly negligently report incorrect information about violations, your identity will not be protected by law. We must forward information, as far as it is known to us, that concerns your identity, if law enforcement authorities, courts or similar bodies mentioned in § 9 HinSchG request it. Forwarding may also take place if it is necessary for follow-up measures. Information about the identity of persons who are the subject of your report may also be forwarded if this is necessary for internal investigations by the internal reporting office at NOW, if it is necessary for follow-up measures, or if it has been requested by courts/law enforcement authorities.

Potential offenders will be informed after the process has been completed that a report has been received via the internal reporting office, which has made the processing of personal data necessary.
